A RELAÇÃO ENTRE O BEM E A JUSTIÇA NO PENSAMENTO DE MILL E RAWLS

O objetivo do presente trabalho é lançar luz sobre as diferenças e semelhança entre as doutrinas de John Stuart Mill e John Rawls no que concerne a relação entre bem e justiça. Na primeira parte do artigo o leitor é apresentado a temática do trabalho. Na segunda as ideias de bem e justiça no pensamento milliano. Na terceira parte as ideais de bem e justiça em Rawls e na quarta a identificação das semelhanças e diferenças entre as doutrinas. Nas considerações finais é realizado um breve balanço e apresentado as conclusões sobre as semelhanças entre as teorias e a filiação dos autores ao perfeccionismo moderado. Em ambas as doutrinas, os elementos consequencialistas são evocados na ideia de um desenvolvimento saudável das capacidades humanas. Como classifico os autores como perfeccionistas moderados, é natural questionar se isso implicaria em algum tipo de paternalismo. Acredito que não, pois, tendo vista que, como percebemos pelo perfeccionismo moderado de ambos, o aparelho estatal deve, por meio de instituições justas, promover condições adequadas para o desenvolvimento das capacidades humanas. Entretanto, o papel do Estado limita-se a promover, fomentar e estimular os indivíduos a almejarem o autodesenvolvimento, porém, é vedado, para ele, a imposição mediante legislações de qualquer modo de vida.
